Louisiana's
Fourth Circuit Court of Appeals has ruled that a professional videographer
is required when having a deposition videotaped.
In the medical malpractice case, the plaintiffs gave notice of
a "videotape" deposition to be done by the plaintiff's
attorney’s staff member. A court reporter was present as required
by law.
The judge declared that “accuracy and trustworthiness of
the videotaped deposition must be provided for. In any non-videotaped
deposition, a certified stenographic reporter is required in order
to protect the objectivity and validity as well as the accuracy
and trustworthiness of the transcribed deposition. It would be inconsistent
to provide for a certified professional reporter to be used when
transcribing and not to require that a professional videographer
be used in a videotaped deposition.”
The implications of that ruling have sent many law firms scrambling
to line up professional legal videographers to avoid having a favorable
outcome overturned because professional video specialists were not
used.

relying upon DepoNet’s nationwide network of legal video service
